MARPOL 73/78 Annex VI Reg.16 Shipboard Incineration Interpretation of "installed on board"
When MARPOL 73/78 Annex VI enters into force in the future, each incinerator installed on board a ship on or after 1 January 2000 shall be approved by the Administration taking into account the IMO standard of Resolution MEPC76(40). Therefore, with regard to new building ships which are at stages of construction on or before the end of 1999 and will be delivered on or after 1 January 2000, we recommended you to request our Survey Office to confirm the date of installation of the incinerator in order to keep an official record document as stated in NK Technical Information No.311 dated 17 May 1999.
IACS had been discussing the date of installation of the incinerator and has issued the unified interpretation MPC8 as attached hereto. We understand that "new ship" in the interpretation means "a ship the keel of which is laid or which is at a similar stage of construction on or after the date of coming into force of the Annex", and "existing ship" means "a ship which is not a new ship". The ship under construction at the present time is classified into "existing ship". Consequently, it is possible that "the date of installation of the incinerator" is interpreted as "the contractual delivery date of the incinerator to the ship or, in the absence of a contractual delivery date, the actual delivery date of the incinerator to the ship".
At present, the Annex is contracted by only two States, Norway and Sweden, and the Society is authorized regarding the Annex by only few Governments. Under the conditions, there is a possibility that other interpretations may be issued from Governments. We assume that the consent of Governments is necessary to proceed with the above interpretation.
Therefore, we are inquiring of the concerned Governments to obtain their consent, whose flag will be flown by the new building NK ships which are at stages of construction on or before the end of 1999 and will be delivered on or after 1 January 2000. Please contact the department listed below about the replies from the respective Governments.
NK Technical Information No.311 is still effective and we would like to recommend you to request our Survey Office to confirm the date of installation of the incinerator.
