MEPC Resolution 78(43) Annex paragraph III regarding the amendments of MARPOL 73/78 Annex II comes into force on 1 January 2001. The new requirements adopted as Reg.16 of MARPOL AnnexII require that every tanker which is certified to carry noxious substances in bulk of 150 gross tonnage and above shall carry on a Shipboard Marine Pollution Emergency Plan (hereafter referred to as SMPEP) approved by the Administration not later than 1 January 2003.

Please refer to the detailed procedure for approval in the attachment. We will keep you informed of any information regarding further authorization when we received.

Shipboard Marine Pollution Emergency Plan(SMPEP)

1. Contents of SMPEP
When preparing a SMPEP, please refer to " Rules and Guidance for the Survey and Construction of Marine Pollution Prevention Instructions of Ships, as amended *Note" and "The Guidelines for the Development of Shipboard Marine Pollution Emergency Plans for Oil and/or Noxious Liquid Substances, MEPC Res.85(44)".
* Note: These amendments will be effected on 1st January 2001.

2. Plan Approval and Survey
(a) For ships registered in Japanese Government, NK is authorized to conduct approval of the Plan and the survey that it is carried on board under the Government's authorization.
(b) For ships flying the following flags, NK is authorized to conduct approval of the Plan and the survey that it is carried on board as a part of NLS survey on behalf of the Government.
Antigua and Barbuda, Australia, Bahamas, Barbados, Bolivia, Brunei,
Cape Verde, Equatorial Guinea, Georgia, Greece, Iceland, Kuwait,
Liberia, Luxembourg, Marshall Is., Philippines, Vanuatu

(c) For ships flying the flag other than the above mentioned(e.g. Panama etc), the authorization is to be confirmed with each Government.

3. Application of approval
You are requested to submit Machinery Department 2 copies of the plan at least and an application on which following items should be included;
a. Applicant's Signature, Name of Company, Address, Tel & Fax No.
B. Name of ship, Class No.
C. Date and Place of Survey (as far as possible)
d. Address where approved plans should be returned
e. Name and Address of Company responsible to fees

4. Other information
For information to the shipowners, the following NOTE will be described on her Survey Status of all subjected chemical tankers.
Note: The approved Shipboard Marine Pollution Emergency Plan for noxious liquid substances to be placed on board by 1st January 2003.
