For ships flying Japanese flag, Correction of description on the certificate of fitness for ships carrying dangerous goods. (Prohibition of stowage of such Class 5.2 dangerous goods; "Organic Peroxides" under deck or in enclosed spaces)
Japanese Government has informed ClassNK of following treatment regarding the certificate of fitness for ships carrying dangerous goods. (Hereinafter referred to as "DG certificate")
It is required for Ships flying Japanese Flag to follow necessary procedure mentioned below.
Where in the case that the DG certificate which have description that Class 5.2:"Organic Peroxides" is permitted to carry in the space other than "Weather Deck", it is necessary to amend it so that the cargo is prohibited to carry except "Weather Deck".
1. Time of the amendment
At the first renewal of the DG certificate on or after 12 September 2008. (Including at the Occasional Survey)
2. Procedure for the amendment
If you find, on the DG certificate, the description that Class 5.2:"Organic Peroxides" is permitted to carry in the space other than "Weather Deck", please ask attending Surveyor for correction of DG certificate.
Upon completion of the survey, survey branch / office of Class NK will issue the necessary documents which are required to be submitted to Japanese Government for the amendment of the DG Certificate.
3. Background
The DG Certificate is one of the certificates related to SOLAS, and so far, as the interpretation of Reg. 19, Chapter II-2, of SOLAS, Class 5.2 dangerous goods; "Organic Peroxides" is permitted to be carried at under deck or in enclosed Ro-Ro spaces. On the other hand, Chapter 7.1 of the IMDG Code specifically states that Class 5.2 dangerous goods; "Organic Peroxides" is permitted to be carried on weather deck only but not under deck or in enclosed spaces and in fact, it was not able to carry Class 5.2 dangerous goods; "Organic Peroxides" at under deck or in enclosed spaces.
To solve the discrepancy, it was agreed by IMO DSC Sub-committee to amend the DG Certificate.
It should be noted above, under no circumstances shall Class 5.2 dangerous goods; "Organic Peroxides" be permitted to be carried under deck or in any enclosed space at any time.
