The United States Coast Guard (USCG) has issued a directive on the "Banning of Foreign Vessels" (CG-543 Policy Letter 10-03 dated on 1 September 2010), which is a new policy outlining U.S. Coast Guard procedures for denying entry of certain foreign flagged commercial vessels into any port or place in the United States due to their history of operating in waters subject to U.S. jurisdiction in a substandard condition, outside acceptable standards. The New Inspection Regime (NIR) of Paris MOU

The Paris MOU has introduced a New Inspection Regime (NIR) which shifts from a target of inspecting 25% of individual ships calling at each member state to a shared commitment to achieving full coverage inspection of all ships visiting ports and anchorage in the Paris MOU region. A brief overview of the NIR is presented below. 1. Implementation The NIR will replace the existing PSC regime on 1 January 2011. 2. Panama Maritime Authority has notified ClassNK of Merchant Marine Circular No.173 (hereinafter, the circular) regarding guidelines related to the Paris Memorandum of Understanding (hereinafter, Paris MOU) as per attached. As per the Circular, all vessels of twenty (20) years of age or more, which are calling at a port or operating within the ports of country members to the Paris MOU, are required to undergo an occasional survey in order to improve the performance of the Panamanian Registry within the Paris MOU. A number of deficiencies regarding oil filtering equipment and oil content meters in engine rooms have been pointed out during PSC inspections conducted recently all over the world. There have been ships that were detained for a long term till complete repairs were completed. PLEASE BE INFORMED THAT Port State Control (PSC) inspectors have been pointing out deficiencies in many divergences during their recent inspections, which result in detentions of many ships. Among the deficiencies the largest number reported was in the category "Others" which includes repairs by taping and/or putting pad plates on sea water/sanitary piping in Engine Room and sea water piping on weather decks. These detentions are judged to be attributable to the fact that the PSC inspectors do not recognize taping and putting pad plates as effective means of permanent repairs for piping. It is, therefore, recommended to provide for the measures listed below in the event of damage to the piping in engine rooms and on weather decks while at sea. 1.

Recently, the Society has received a considerable number of inquiries relating to ships which have been released by Port State Control (PSC) after proper rectification of PSC-related deficiencies but which still have ISM-related non-conformities remaining as pending items, particularly with regard to: 1. Why corrective actions are required despite the fact that deficiencies have been rectified; and 2. How corrective actions should be taken in order to remedy ISM-related non-conformities.
